o1. About These Terms
These Terms of Service (“Terms”) govern your access to and use of:
- www.thekey-ai.com (the “Website”)
- BES — Bespoke Experiences Studio, accessible through app.thekey-ai.com (the “Application”)
- any related services provided under The Key AI brand (collectively, the “Services”)

Throughout these Terms, “The Key AI”, “we”, “our” and “us” refer to the Service Provider identified above.
The Services are intended exclusively for licensed travel professionals, agencies, businesses, and self-employed professionals operating within the luxury travel industry. The Services are not available to consumers or individuals purchasing travel for personal use.
By accessing or using the Services, creating an account, or requesting Early Access, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Services.
02 BES — Bespoke Experiences Studio
The Key AI develops intelligent software designed to support professionals working within the luxury travel industry.
BES — Bespoke Experiences Studio is an AI-assisted application that enables users to research, organize, refine and create bespoke travel content.
BES is designed to support the creation of Journeys, Experiences and Destinations, as well as related research, recommendations, inspiration and supporting travel content.
For the purpose of these Terms, a Journey refers to a multi-day bespoke travel creation within BES; an Experience refers to a single curated travel moment, activity, venue, service or point of interest; and a Destination refers to a city, region, country or other geographic location associated with a Journey or Experience.
BES is intended to enhance professional workflows by reducing the time required to research, organize and structure information while preserving the expertise, creativity and judgment of the user.
The Services are intended for professional use and are not directed toward consumers purchasing travel arrangements. The Key AI is not a travel agency, tour operator, accommodation provider, airline, transportation company or booking platform. The Services do not sell travel products or execute travel reservations.
03 Eligibility and Accounts
- are a licensed travel professional, self-employed travel professional, business, or agency
- have reached the legal age required in your jurisdiction
- are legally able to enter into a binding agreement
- use the Services in compliance with applicable laws
- Accurate and complete business information
- A valid VAT number (NIF/NIE for Spain, or equivalent in your jurisdiction)
- Current business registration details
04 Early Access
During the Early Access phase, certain features may be incomplete, modified or unavailable.
By participating in Early Access, you acknowledge that:
- the Services are under active development
- functionality may change without prior notice
- features may be added, modified or removed
- occasional interruptions or errors may occur
Access to Early Access is granted at our discretion. We reserve the right to approve, refuse, suspend or revoke Early Access at any time.
Participation in Early Access does not guarantee continued access or future availability of any specific feature.
05 Payments and Billing
During the Early Access phase, access is provided to qualified travel professionals and businesses. Pricing and payment terms are agreed individually. Early Access may be suspended or terminated at The Key AI’s discretion. No refunds are offered for Early Access participation.
Where payment is required, billing and account activation are managed manually.
If payment is not received in accordance with the agreed terms, we may suspend or revoke access to the Services until payment has been completed.
As BES evolves into its full SaaS offering, subscription plans, pricing, billing methods and payment options may change. Any changes will be communicated before they become effective.
06 Acceptable Use
BES is designed to support professionals in creating bespoke travel content. You agree to use the Services responsibly and in compliance with all applicable laws and regulations.
You may not:
- use the Services for any unlawful, fraudulent or misleading purpose
- attempt to gain unauthorized access to the Website, Application or related systems
- interfere with the security, integrity or availability of the Services
- introduce malware, viruses or other harmful code
- infringe the intellectual property rights of The Key AI or any third party
- use the Services in a manner that could damage, disable or impair the platform
BES is intended to create and organize professional travel content. It is not designed to store confidential or sensitive personal information.
Users should not upload or store passport details, government-issued identification numbers, payment card information, health information or any other special-category personal data within the Services.
We reserve the right to suspend or terminate accounts that violate these Terms or misuse the Services.
07 AI Features
BES incorporates artificial intelligence to support the creation of bespoke travel content.
AI features are integrated throughout the platform to assist users in researching, organizing, refining and generating content related to Journeys, Experiences and Destinations.
Some AI functionality is provided through trusted third-party technology providers.
The AI capabilities available within BES form part of the Services and may evolve over time as new functionality is introduced or existing features are improved.
Users remain responsible for how they use the Services and for ensuring that any content they create or share complies with applicable laws, contractual obligations and professional standards.
08 Content and Intellectual Property
The Key AI and BES, including their software, design, branding, technology and related intellectual property, are owned by The Key AI or its licensors and are protected by applicable intellectual property laws.
You retain ownership of the original content and materials you create within BES.
To provide the Services, you authorize The Key AI to securely store, process and display the content and materials you create within BES solely for the purpose of operating BES. This authorization does not transfer ownership of your content to The Key AI.
You may not copy, reproduce, modify, distribute, reverse engineer or otherwise exploit any part of the Website or BES except where permitted by applicable law or with our prior written permission.
09 Availability and Third-Party Services
We may update, improve or modify BES from time to time to enhance functionality, performance, security or the overall user experience.
While we aim to provide reliable access, we do not guarantee uninterrupted availability. Temporary interruptions may occur due to maintenance, updates, security measures or circumstances beyond our reasonable control.
The Services rely on trusted third-party providers for certain functionality, including hosting, analytics and artificial intelligence. These providers operate under their own terms and privacy policies.
The Key AI is not responsible for the availability or performance of third-party services that are outside our reasonable control.
10 Limitation of Liability
We strive to provide reliable and secure Services. However, to the fullest extent permitted by applicable law, The Key AI shall not be liable for any indirect, incidental, consequential or special damages arising from or relating to the use of, or inability to use, the Services.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.
11 Privacy
Your privacy is important to us.
Our collection and use of personal information are described in our Privacy Notice, which forms part of these Terms. By using the Services, you acknowledge that your personal data will be processed in accordance with our Privacy Notice.
12 Changes to These Terms
We may update these Terms from time to time to reflect changes to the Services, applicable laws or our business operations.
The most current version will always be available on our Website and will indicate its effective date.
Your continued use of the Services after updated Terms become effective constitutes your acceptance of those changes.
13 Governing Law and Contact
These Terms shall be governed by and interpreted in accordance with the laws of Spain.
Any dispute arising from these Terms or the Services shall be subject to the jurisdiction of the competent courts of Spain.
